By downloading, installing, or using any ShattoPrep Engineering application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
These Terms constitute a binding agreement between you and ShattoChem Enterprises LLC (“Company,” “we,” “us,” or “our”). Your use of the App is also subject to our Privacy Policy.
2. Description of Service
ShattoPrep Engineering Suite provides educational practice tools and reference-navigation training designed to help engineers prepare for NCEES Fundamentals of Engineering (FE) and Principles and Practice of Engineering (PE) examinations. The Apps are independent educational products and are not affiliated with, endorsed by, or sponsored by NCEES or any state licensing board.
3. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial educational purposes on devices that you own or control.
4. Purchases and Payments
Certain features or content packs within the App may require in-app purchases. All purchases are processed through the applicable app store (Apple App Store or Google Play). Pricing, payment terms, and refund policies are governed by the respective store’s rules. We do not process payments directly.
5. User Responsibilities
You agree that you will:
- Use the App only for lawful educational purposes
- Not attempt to reverse-engineer, decompile, or modify the App
- Not share, resell, or redistribute paid content
- Not use the App in any way that could damage or impair its operation
6. Intellectual Property
All content, design, code, graphics, and trademarks associated with the App (except third-party trademarks such as NCEES®, FE®, and PE® used solely for identification) are owned by or licensed to ShattoChem Enterprises LLC and are protected by intellectual property laws.

To the maximum extent permitted by law, ShattoChem Enterprises LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
9. Apple App Store Specific Terms
If you downloaded the App from the Apple App Store, the following additional terms apply:
a. These Terms are between you and ShattoChem Enterprises LLC only, and not with Apple Inc. (“Apple”). Apple is not a party to this Agreement and is not responsible for the application or its content.
b. Apple has no obligation whatsoever to furnish any maintenance or support services for the application.
c. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the application to you. Apple has no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty will be the sole responsibility of ShattoChem Enterprises LLC.
d. ShattoChem Enterprises LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the application, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to applicable legal or regulatory requirements; and (iii) claims arising under consumer protection or similar legislation.
e. In the event of any third-party claim that the application, or your possession and use of that application, infringes that third party’s intellectual property rights, ShattoChem Enterprises LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
f. You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
g. Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of it.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
